The Town of Indian Trail Passes Resolution Opposing House Bill 765 and Related Bills

On April 22, the Indian Trail Town Council unanimously approved a resolution opposing changes to local planning and zoning in House Bill 765 and related bills.

House Bill 765 and similar bills that the North Carolina General Assembly is considering would drastically reduce local control regarding planning and zoning, fast-track development in our community, and remove the Town’s ability to manage growth and shape our future.

Numerous other communities have expressed opposition to House Bill 765, including Stallings, Monroe, Waxhaw, Fairview, Harrisburg, Albemarle, Granite Quarry, Yadkin County, Clemmons, Kannapolis, Lewisville, and Kernersville. To raise awareness and support this growing opposition, the Town of Indian Trail is sending this resolution to all NC General Assembly House members.

Why the Town of Indian Trail Opposes House Bill 765

Loss of Local Control

House Bill 765 would:

  • Retroactively void local development ordinances.
  • Remove authority from planning or governing boards to approve preliminary or final subdivision plats.
  • Restricts local government zoning authority in residential development by removing the authority to require parking, set driveway requirements, require sidewalks unless they connect to existing ones, and require building design standards, among other restrictions.
  • Limit local government to require transportation-related improvements unless the need is established through “substantial evidence.”

Elimination of Citizen Input

House Bill 765 would:

  • Undermine the Town’s commitment to transparency and accountability.
  • Eliminate public hearings and citizen input for subdivision decisions.
  • Prohibits voluntary conditional rezoning agreements. 

Increased Density

House Bill 765 would:

  • Ban classifying density by lot size.
  • Require local governments to allow at least five housing units per acre.

Increased Liability

House Bill 765 would:

  • Expand the right to sue local government officials and staff for development regulation decisions.
  • Expand the circumstances when a local government decision-making board can be held personally liable for involvement in board decisions and allow for the award of attorneys’ fees and other costs.
